Trump Calls Military Constitutional Duty “Sedition” — Demands Death by Hanging
Six veterans reminded troops to refuse illegal orders. The President called for their execution.
The Week the President Declared the Constitution a Crime
On Tuesday, six Democratic lawmakers — all veterans of the military or intelligence community — released a 90-second video reminding U.S. service members of their legal obligation under the Uniform Code of Military Justice: you must refuse unlawful orders.
That is not subversion.
That is page one of American military law.
That is the oath every service member swears.
On Thursday, the President of the United States responded by calling these lawmakers traitors, demanding they be arrested and sharing posts calling for them to be hanged.
“HANG THEM GEORGE WASHINGTON WOULD!!”
— Donald Trump, reposting an anonymous supporter
Then the president went further. He declared their reminder of military law to be:
“SEDITIOUS BEHAVIOR, punishable by DEATH!”
— Donald Trump
When Donald Trump calls the lawful refusal of illegal orders “sedition,” he is not talking about public safety or “respect for the chain of command.” He is talking about loyalty to himself above the Constitution.
And he is telling the country — openly — that constitutional fidelity is now a capital offense.
What the Lawmakers Actually Said
The video contained two simple statements:
“Our laws are clear: You can refuse illegal orders.”
— Sen. Mark Kelly (D-AZ), Navy veteran and former astronaut“You must refuse illegal orders.”
— Rep. Chris Deluzio (D-PA), Navy veteran
Not one of the lawmakers claimed Trump had already issued an unlawful order.
They were reminding troops of their obligations before that moment comes.
Because as Rep. Jason Crow — former Army Ranger — put it:
“I don’t want to wait until it happens. Then it will be too late.”
This is not rebellion. This is responsible civilian oversight of the armed forces. This is our elected representatives doing their duty.
Duty to the Constitution is the very thing Trump is trying to redefine as treason.
What the Law Actually Says
The 2024 Manual for Courts-Martial makes the rule explicit:
“An order is lawful unless it is contrary to the Constitution, the laws of the United States, or lawful superior orders… This inference does not apply to a patently illegal order, such as one that directs the commission of a crime.”
And:
“The lawfulness of an order is a question of law to be determined by the military judge.”
Meanwhile, Articles 90, 91, and 92 of the UCMJ require obedience only to lawful orders.
Meaning:
Unlawful orders must be refused.
Executing an unlawful order can itself lead to court-martial.
Troops swear an oath to the Constitution, not to any president.
This is the legal foundation Trump is trying to criminalize.
Trump’s Interactions with Military Leadership
Trump’s rage at the six lawmakers is not an unusual outburst.
It is the continuation of a years-long battle against senior military leaders who refused to pledge personal loyalty to Trump.
Each of these men are four-star generals.
Gen. James Mattis, former Secretary of Defense:
“Donald Trump is the first president in my lifetime who does not try to unite the American people.”
Gen. John Kelly, former White House Chief of Staff:
“The most flawed person I’ve ever met… He has no idea what America stands for.”
Gen. Mark Milley, former Chairman of the Joint Chiefs:
“We don’t take an oath to a wannabe dictator.”
Trump treated these military heroes with the same disrespect that he showed today when he responded to six veteran Democrats, demanding loyalty, criminalizing dissent and treating constitutional duty as insubordination.
His expectation has been consistently incorrect: Military allegiance belongs to Donald Trump and not to the Constitution.
A New and Alarming Shift Inside the Armed Forces
On Thursday, another development signaled how quickly the norms governing military culture are eroding.
According to documents obtained by The Washington Post, the U.S. Coast Guard will no longer classify swastikas, nooses or the Confederate flag as “hate symbols.” Beginning December 15, these icons will instead be considered merely “potentially divisive.”
One Coast Guard official, speaking anonymously for fear of retaliation warned bluntly:
“We don’t deserve the trust of the nation if we’re unclear about the divisiveness of swastikas.”
They described the reality aboard ships:
“If your shipmate has a swastika in their rack, and you are Black or Jewish, are you going to feel safe reporting that?”
This shift is not neutral. It is the normalization of symbols of racial terror within a branch of the armed forces — at the very moment the president is demanding execution for elected officials who restated established military law.
The message to troops is unmistakable: Obey Trump or else.
Constitutional loyalty is punished. Extremist symbols are dismissed as merely “divisive.”
This is how authoritarian governments reshape military culture from the inside.
The Fever Breaks in Congress
The reaction from congressional leadership was immediate and unambiguous.
Sen. Chuck Schumer
“The President… is calling for the execution of elected officials.
This is an outright threat, and it’s deadly serious.”
Sen. Chris Murphy
“If you haven’t picked a side, maybe now would be the time to pick a fucking side.”
House Democratic Leadership
“Donald Trump must immediately delete these unhinged social media posts and recant his violent rhetoric before he gets someone killed.”
The House Sergeant at Arms and U.S. Capitol Police have been contacted to protect all six lawmakers and their families. Read that again!!!
We are not in the realm of hypotheticals. We are in the realm of risk assessments.
The Pattern Is the Point
In the span of 48 hours, Trump:
called constitutional duty “sedition”;
demanded the execution of lawmakers;
reposted calls for their hanging;
tried to redefine illegal orders as legal by presidential decree;
escalated his war on military norms;
and watched as a branch of the armed forces reinterpreted hate symbols as “divisive.”
These are not disconnected events.
They are the components of an authoritarian ecosystem.
“Totalitarianism in power invariably replaces all first-rate talents, regardless of their sympathies, with those crackpots and fools whose lack of intelligence and creativity is still the best guarantee of their loyalty.”
― Hannah Arendt, The Origins of Totalitarianism
When the president calls obedience to the Constitution a crime, the entire structure of democratic governance is at risk.
Pulse Check, The Diagnosis: The patient is at risk for a sentinel event.
The real danger is not Trump’s rage. It is his lack of regard for the Constitution.
Loyalty to the Constitution is treason. Loyalty to the Donald Trump is the law.
This is how autocracies function. This is how republics die.
The six lawmakers reminded the military who they serve.
Trump reminded the country who he believes should be served.
And the Coast Guard’s shift on hate symbols — in this moment, under this president — is not administrative. It is a harbinger.
This is a time for moral clarity.
Fear is contagious.
So is courage. Be courageous.
Don’t Give Up the Ship.
